Being charged cancellation f room hire

I booked room hire for an event I've had to cancel. We've given the venue a week's notice. They are trying to charge 25% of the cost. There were no written booking conditions or other indication of a charge. It was all done by email. It isn't an organisation which makes their money from events, just someone who rents out a meeting room when not in use.

Do they have a leg to stand on introducing this charge after the fact? I'm thinking not but obviously am concerned!

Are there any T&Cs on their website, or can they give you written confirmation that there is a cancellation fee mentioned somewhere in their T&Cs and a copy of this text?

If there's no written contract containing the cancellation fee as term and conditions or it wasn't mentioned to you prior to booking, then I suspect they haven't a leg to stand on.

25% is pretty generous for such short notice. Chances of a relet are very low. Are there terms on their website? Did you pay a deposit ?

I've checked their site and there are terms and conditions including this charge linked to right at the bottom of one of their pages. We didn't know about these. We hadn't booked through the site. There is no reference to terms and conditions in any of the correspondence.

If we had known about this we either wouldn't have cancelled or would have cancelled earlier. Haven't paid anything.

It is a significant amount. I am hoping it will be straightforward to resolve once they realise there no contract. If there were terms and conditions provided I'd adhere to them, but I'm not happy with them being introduced retrospectively!

Hopefully someone will be along soon to give you the legal take on it all. My understanding is that they should have sent you a copy of the T&Cs - how did you find the venue, ie was it through their website?

It was word of mouth.

I've spoken to a friend who s a solicitor and says they don't have a case, which is a relief!
