Registration of child as British after ILR approved

Hi,

This is my first post - hopefully I've got it in the right section!

I'm pregnant with my first child, due later this year. My husband and I are both non British but can apply for Indefinite Leave to Remain in early January.

As I understand it, once we have ILR we can apply for the child to be registered as a British citizen using form MN1. And once the child is a British citizen we can travel overseas (can use a foreign passport and the citizenship paper to get entry back into the UK).

I was wondering whether anyone had any experience with this and the timelines involved? A good friend is getting married overseas in mid to late January and I'd love for us to go, but from my research it sounds like it can take up to two months for the form MN1 to be approved?
We should be able to get a in person ILR application appointment just after new years, and then the ILR cards take up to a week to arrive, then we can use form MN1 to apply (with our cards).

I know there is another route to get the baby ILR but this will cost £2000 on top of the MN1 fee of ~700 only 10 weeks later.

Any suggestions/experiences/tips would be much appreciated!

if you hold ILR before the baby is born AND the baby is born in the UK the baby is a British citizen at birth. you apply for a child passport.
This is all explained on the paperwork you get when you receive ILR.

If you hold ILR and baby is born outside of the UK they are not British citizens.

sorry I read that as you GOT ILR this past January. my mistake.
There is a great online form and your question will be answered very quickly by knowledgeable people. google immigration board and it will come up.

im waiting on my naturalisation application coming back atm, very stressful!

Watching with interest. May i ask what is the other route?

Personally i wouldnt plan any trips before getting everything sorted out.

Hi Nolim, the other route is applying for a Tier 1 dependent visa for the baby which costs just under £2000.

I see, definitely a less desirable option. Can you apply for ilr for the baby so that he can reenter the uk while the mn1 goes through?

I am seeing that the mn1 atm is being processed very quickly.
I would apply for mn1 as soon as the baby is born and also apply for a passport from your current home nation.
presumably baby can enter the UK on his or her other passport and stay as a visitor for 6 months, their application won't take that long.

there are no rules saying you can't travel during the application for British citizenship.

That may not be true depending on the other country. Even if it is i remember seeing in another forum that that could be problematic since the baby would be reentering the uk as a turist but definitely not the intention!

Hi I'm so confused right now. I got my British citizen some years before applying for my son to come to the UK. I did not know then that I could have applied same time for my son to get British citizen at the same time. I brought him to the country going four years now. I phoned up Home office few years ago and explain to them that my son have valid from and valid expired in his passport also his passport will be expired around the same time has the visa. The person I spoke with told me the same thing has my solicitor then that it means that the time they gave is period of when to come to the UK so it's ok. Is this correct or does this mean that the time they gave him is for him to sort out in getting indefinate leave before the date expires? I was told too that he is to wait 5 years for British citizen? Is there a difference between indefinite leave to enter than indefinite leave to remain because I was also told that they are the same? What form is my son to use mn1 or not form? He is 17 now. Please I need help.
