I've been an idiot, I know.

Received a Notice of Intended Prosecution by British Transport Police for Section 36 Failing to comply with traffic signs. I crossed a level crossing after the red lights started flashing but before the barriers came down. At this stage I'm being asked to inform them who was driving, which I'm of course going to do. What is the likely penalty / result? Course? Points and a fine? Court Appearance and loss of licence?

Not at all looking to dodge responsibility, just would like an idea of possible sanctions as I'm trying not to have a panic attack catastrophising losing licence, job, home, etc.

Its not the worst thing you could do. www.gov.uk/penalty-points-endorsements/endorsement-codes-and-penalty-points

But it was a bit silly.

Points and a fine probably. Just don't do it again.

EhricLovesTheBhrothers · 09/03/2015 16:51

Sorry I see you're anxious - I ran a red light a few years ago and got £60 fine and 3 points. They won't take your licence for this, a notice of intended prosecution just means they caught you!

Comito · 09/03/2015 16:54

Three points and a fine from what I can find.

As Ehric says though, mind you don't do it again - BTP are cracking down big time on people jumping level crossing lights.

ItsJustPaint · 09/03/2015 16:56

Wow

Did you know you had done this ?

NerrSnerr · 09/03/2015 16:58

I think it's a good thing the btp are on top of this. Just reading the OP has made my heart go.

Yes, points and a fine, i'm afraid. Just be glad you're alive!

Hi. I had a similar thing a couple of years ago, although it was just the amber light on, not the flashing red. I filled in the form that came with the notice, explaining some relevant circs (road wet, another car close behind, concerned about safety of braking suddenly) and was then given the option of attending a rail crossing awareness course which I did. I don't know whether that's a standard option though.

The course features police camera footage of people doing some absolutely hair-raising things Sad

Agree with Nerr. It is scary that anyone would take a risk like this.

I've had a healthy regard for level crossings since the wife of a fireman told me, in fairly graphic detail, about clearing up after pedestrians and cars who have been hit by trains.
