Ex-Partner Filing Non-Molestation Order Against Me

Sorry if this is long. I suffered emotional abuse, including gaslighting, by my ex-partner for around several months.

Towards the end of this time he threatened to speak to my psychiatrist (I suffered severe postnatal depression and psychosis and still suffer from depression) and tell her that I was unstable, reckless and an endangerment to my DD so they would take her away from me (he's not the father). He then continued that he would not stop until I was homeless and bankrupt. I have some of this as an audio recording he didn't know I made. He then called me a "Stupid F-ing Bitch" and in a moment of fury I slapped him. When I did he laughed, said "that's assault" called the police and had me arrested.

The police were very kind and rushed the charges through quickly so I didn't have to stay long and could be returned to my daughter (who was staying with friends). I was completely honest with the police and released with a caution.

He has refused to leave the property (we're both on the tenancy agreement) so since the incident over 2 weeks ago my daughter and I are essentially homeless and are staying with friends.

I've now discovered that he has applied for a non-molestation order against me! He's stated that he's filed for an "adjourned non-molestation order" but I'm not sure what that means. Will I have to go to court?

I'm so frustrated that he was so horrid to me for so long and yet he is playing the victim. My daughter is distraught that we can't live in the house (which backs onto her school) and I am feeling more and more upset about this.

Does anyone have any advice? Feeling very lost... Thanks

If you can afford a solicitor it would be better. It sounds like you need to put together a written witness statement for the hearing and send to the court and him in advance and also at the hearing argue as to why the order should not be granted but you would be better off using a solicitor used to these kinds of applications. Have you been sent a date for his application for the hearing to be heard at a court hearing?

Hi Jilly - thanks for responding. I haven't seen or heard anything. I've contacted a solicitor but worried about costs. Might be the only way forwards I guess.
