Signed off from work

One of my members of staff has been signed off from work for 2 weeks. Their job is part time with me and part time with another company. The GP has only signed her off from one of the jobs and not the other can this be correct? The member of staff is off with stress and both jobs are identical.

The jobs might be identical, but the work places and people in them won't be.

Therefore, it sounds like working in one of the places is causing her stress, but the other isn't.

Have you seen the fit note? It would be extremely unusual for a GP to specify which employer an employee can work for rather than what duties they are fit to do.

Do you have access to an employer's advice line or similar? I would be wanting to speak to an occupational health expert.

There must be something going on in your workplace that you haven't addressed properly, causing stress to your employee. They clearly need some help and support from you.

Instead of being concerned with the legal ins and outs of whether this is 'correct' perhaps you might consider why her GP has felt it appropriate to sign her off sick with stress from your workplace and not the other job. Clearly she needs support and help and there must be a rather large issue that is not being addressed in your place if work if stress is being cited.

Surely a sick note specifies the reason for absence not the location? I would imagine there is either one sick note that is shown to both and copied for one? Or maybe two separate notes saying the same thing?

Are they off with stress or stress at work.
To my knowledge you can not be off from one job but only one fit note is given.
Look at the regulations on dwp employers section.
For what it is worth since the new fit note many gps and employers do not really know the regulations. Ie employers ask for a return to work note from GP, or signed back to work if member wants to back early neither are needed and not from a GP

You cannot have 2 notes it has to be copied

If the note says not fit for work it means not fit for any work therefore they have to be off from both jobs.
If it says maybe fit for work this may alter things

Thank you to everyone for your response, after speaking with a lawyer today our employee is ok to still be at work with us and off from the their other job. Sick note seen and verified Smile
