Planning application - can I take action on a personal attack?

Hello

I'm quite upset about this and would appreciate some advice. Our flat is next to a catering company which is governed by restrictions on hours of operations. They routinely ignore them and I have e mailed them to ask them to stop quite a few times. They seem to have got better, and I've not had to be in touch for at least a year. Upstairs neighbour has officially complained to council. Another company is next door and the women who runs it is a big supporter of them.

The company applied to extend their hours and I objected, alongside others, sticking to why the extension would be counter to policy.

The other women had replied, after the deadline, and I've just read Her comments. They all focus on me, calling me a 'mother' throughout and saying that I bullying them, have been rude (I haven't) and that I should have done my research before buying. I did - there are restricted hours! We're desperate to sell our house for other reasons, and I'm worried sick. I'm also feeling really bullied.

Since her comments are not really about the application, is there any way the council can be made to take down the comments? They're essebtially just a public, personal attack. Surely this can't be allowed to stand because it's under the guise of responding (late) to a consultation?
Any help greatly appreciated.

Might it amount to libel? Is it actually materially untrue?

Yes, you certainly can complain about libellous remarks on a planning application. Screenshot the comments and email the planning case officer - their name should be on the planning application details online.

Quote to them their website users' terms which should also be on their planning section of the site.

It's the local authority who can be held responsible for allowing the comment to be posted, so they should act quickly to remove or redact.

Push it up to the top if you need to.

Good luck

Thanks. I spoke to local authority who agreed that the comments were not relevant to the application and not acceptable so they've sent on to their technical team to remove. So scared this women is somehow going to scupper house sale.
