MMF Debt Collectors & Their Rights To Visit My Home

I would be so grateful for any help on this one please.

A couple of years ago I (stupidly) took out a Payday Loan and was unable to repay it. I heard nothing from the company for a long time after notifying them of my inability to pay and, again rather stupidly, forgot all about it.

I have now had "contact" from MMF saying that they are going to send a debt collector round to my house to arrange repayment if I do not phone them and pay immediately. This was roughly a month ago and I wrote back (via Signed For) straightaway asking them to prove ownership of the debt or authority to collect it AND telling them not to visit me at home.

They have written back saying that I have no right to say whether they come to my house or not. Apparently they "are different to post men or people asking for directions" and have "the right to pursue the debt in any way they see fit".

Is this right? I have contacted the original loan company and am in the process of arranging to pay them directly. I do not object to paying my debts - but need to know how to call off the dogs (so to speak).

Can they just call round whenever they want? Or should they stop if I withdraw permission?

I am a regular who has namechanged for this by the way.

I think it's just a scare tactic to get you to pay up!

They have the right to pursue the debt anyway they see fit do they? So they can lock up your granny and refuse to release her until you cough up if they see fit to do so? Send people round with baseball bats if they deem it necessary? I suspect they may be over estimating their powers somewhat. I'm sorry I don't know what the right answer is but I do know it's not what they're telling you. Hopefully someone wiser will be along soon to advise you.

I have just phone MMF and spoken to a (very surprisingly) lovely lady who has offered to "freeze" the account pending confirmation from the original lender that we now have a payment arrangement in place.

So they will take no further action. Hopefully Hmm.

LiverpoolLou - exactly. It was phrases such as that in the letter that convinced me they were not acting entirely legally. The law, to my knowledge anyway, is usually much more specific about what is and isn't allowed!
