car accident-liability dispute

Someone crashed into the side of my car today in a carpark. She hit me side on at a right angle as I was driving past a side road iyswim. She had just passed her test and got her car this morning! She is refusing to accept liability. Anyone know what happens now or what the chances are of the insurance company accepting her 'not liable' claim? She crashed into me so surely she is liable?
Advice from anyone in the know greatly appreciated.

I wouldn't worry about her admitting liability, hardly anyone does and it's irrelevant. Just pass it on to your insurance company. They will ask you for a statement. If you had an independent witness that would be good. I assume you got her insurance details?

BlackWings · 09/09/2014 17:09

Oh yes I have been in touch with both insurance companies and given my statement. Her mother phoned me to say she didn't think she was 'entirely at fault'. I was Shock, hence me calling her insurance company. She hit my rear door side on, I was almost past the opening, no idea how she didn't see me. I just don't want this to cost me anything!
no witnesses unfortunately.

Ignore anything she or her mum says. Don't take any more calls from them - if they call you tell them to speak to their insurance company.

Shame about the lack of witnesses, but the other driver was exiting a side road onto another road so it's her responsibility to make sure it's clear before she drives off.

Thanks, feel a wee bit better. Will just leave it up to insurance companies to sort now.

Yep, that's what you pay them for! Good luck with getting it sorted. Smile

Did you get photos of the vehicles in situ, from different angles?

BlackWings · 09/09/2014 17:30

No photos, didn't have my phone on me, literally popped out for 5 minutes to get some forms signed at uni. Wish I stayed in now!

I'm sure that it says in your insurance docs that you should not admit liability, so don't worry about that as it's standard practice.

specialsubject · 09/09/2014 18:49

stay well out of this, refer all calls to insurers, do not admit anything. If mummy calls again say 'sorry, please speak to insurers' and hang up.

she shouldn't admit to you, but pulling out of a side road into you; guilty as charged.

Best thing you can do now is write down what happened in as much detail as possible. Describe where it happened/car park layout/where you came from/where you were heading/when you 1st saw her/became aware of her/where her car made contact with yours/estimate of speed/description on your damage -v- hers/what she said - all the detail about just passing test, collected her car etc. with some photos of your damage clearly showing if there was movement after contact made i.e. as you were moving, the area of damage will start at the point of impact then move along as your car continued. All that can be compared to what she says & how she tries to explain how you were to blame. The detail in your statement & photos will be your insurers best chance to undermine any attempt for her to blame you & convince her ins to settle your claim without you needing to take it to court.
