Last week my ex told DS to pack his bags and leave, he's 12. DS was mortified, he sent me a text threatening suicide.
When I spoke to the social worker she said the case had become a child protection issue and DS was not to return to the ex.
My question is, how do I enforce this? How do I stop him?
Can social services take this to court? I know I need to really but I'm really struggling at the moment, currently selling items to raise court funds.

Has your ds asked to go? Has your ex asked to see him?

DS hasn't asked to go but ex has told him he can "go back whenever".
Ex flies out on holiday tomorrow (convenient that he kicked him out!) but I know that when he comes back he's going to want him to go back ad the emotional blackmail will start again.

When there is a child protection issue you have a duty to protect the child and that may justify withholding contact. Social services can bring a case to court but the majority of applications are care cases. You may need to represent yourself if you can't afford a solicitor, although you could be exempt from court fees. The application forms are available downloaded from the Ministry of Justice website.

Who lives with who? For what percentage time?

loopdaloop · 09/09/2014 11:52

All with me, hes refused contact because he "cant forgot all the names I called him, best to cut his losses, he misses them everyday blah blah blah but its for the best"
Blokes a head case!

I think you need to talk it all through with the social worker. Do have an allocated SW you trust?

Thanks. Do you think this would justify an emergency without hearing case?
