Help - warranty issue

Hi there

I am hoping someone can help. Long time netter but haven't posted in quite a while.

We recently had fake grass installed. The original installation was at the beginning of July. We paid 75% up front. There were some problems with dips appearing and it has taken until last week for the firm to be able to send the team to lay more sand. The dips are now sorted out.

Yesterday I noticed a hole in the grass. We have two dogs and the firm has alleged that the dogs have chewed the grass. The hole is in the middle of an area so even if they did chew it (which they don't) they would surely have chewed at an edge? The hole is not in a patch of grass that has worn away at all, ie in an area of high traffic.

The firm has now come back saying that they think the hole is wear and tear and are not going to fix it. We have another piece of grass that they could replace it with simply by using adhesive and tacking the grass down again. They also said that one of the team noticed the hole the day before, yet no one mentioned it to me.

The firm offers a 5 year warranty but wear and tear clearly would not be covered, which is pretty obvious in any case.

I am waiting for a call back from CAB for trading standards- surely if this is wear and tear then the product is not fit for purpose?

Really hoping someone out there from the collective wisdom can assist!

Hi,

Have a look at Which's website as well. There are some useful resources on there. If I recall, under being fit for purpose includes that it should last for a reasonable time. So even though they are claiming it is wear and tear, the product should last longer than a few months, so you could argue that as well.
