EMPLOYMENT Non payment Issue

Am posting here in the hope someone can help

DH resigned from work gave proper notice and left on 15th June, its taken 6 weeks to get his final wage slip, we had to call numerous times and there was always an excuse (we suspect it was deliberately withheld wage slips always arrived the 1st week after the wage run).

It shows that he had not been paid any holiday pay he is owed at least 10 days he was told 15 when he left but he will accept 10 just to get the matter resolved

They should have paid nursery vouchers via a salary sacrifice scheme and they haven't paid those for the last 3 months

They still have not sent out a P45 and are refusing to answer or respond to any calls or correspondence from us (have posted a copy of the email via SD) so they can't say that they haven't had it

Its not a small sum of money thats owing so fed up that they couldn't even let him leave properly


Any suggestions would be greatly received

Write to them telling them that this is an unlawful deduction of wages and that unless the money owed is forthcoming he will be taking legal action to recover his money. Set a deadline. If they fail to pay he should take them to the Employment Tribunal but he needs to get on with it. As he left on 15th June he needs to make a claim by 14th September at the very latest.

Thanks do we tell them that, it was suggested that we go small claims

Do you know who we should contact to do this

The Employment Tribunal is more appropriate than small claims for a case like this.

You must write to them first before taking legal action. If you do need to take legal action you should take a look at the guidance here. This page includes a link to the online claim form so you can start proceedings. Note that you can claim your court fees from your ex-employer but you cannot claim any lawyers fees. You should therefore do this yourself.

Thanks we've been emailing and posting copies of the emails but nothing not even a reply
