Help with dodgy builder

Passamaquoddy · 08/07/2014 15:07

Hi all. In January we hired a roofer/builder to fix two leaks on our roof. One of the leaks was fixed with no problem, the other is a different story.

He came to rectify the work but left it in a worse state than before and eventually we had to hire another roofer who completed the work for us. After negotiations with the first builder, we agreed on a set amount of money for a refund. We heard nothing from him for weeks so after plenty of messages warning him that we would take legal action, we sent him a letter stating our intentions - no reply - so I put in a claim with money claim online.

I have just received a text from him telling me that he is claiming bankruptcy and "good luck getting what I haven't got"

Is there anything I can do? I am really out of pocket.

Thanks in advance.

Nothing at all. Sorry to be both blunt and the bearer of bad news.

He might be bluffing?
Is the Bankruptcy register worth a look.
Is he still advertising etc?

Passamaquoddy · 09/07/2014 11:06

Thanks for your replies. Ffs, yes I wondered if he was bluffing, I don't think he expected us to take it any further. I searched the register and found nothing. He has announced on his business Facebook page that he is 'closing down' bit he didn't really have much of a 'business' to begin with as far as I could tell, I'm not sure that he was completely above board iyswim.

Was he trading through a company, or personally?

Passamaquoddy · 09/07/2014 12:10

He was trading personally...the receipt he gave me has his name, his company name and his home address.

If he gave you a company name then he was probably trading through a company. Do a search on companies house (free) to find out if it is still trading.

Passamaquoddy · 09/07/2014 13:55

Thanks amateurish. I have searched and I cannot find it on there...what does this mean?

It could a trading name, rather than a ltd company. PM me the name and I'll check.

Amateurish · 09/07/2014 14:44

Yes, looks like no such company so probably a sole trader (i.e. an individual). It might still be worth getting the judgement in default in case he doesn't declare bankruptcy.

Passamaquoddy · 09/07/2014 14:52

Thanks again, Amateurish. I need to wait until the 16th before I can get the judgement in default, so I will keep my eyes open!

have a Brew on me!
