Hi
I am travelling to Brazil shortly with my 10 yo DD for hols. We are both UK citizens and have same surname. Not sure from Brazil consulate website if we need notarised authority to travel from Ex or not. He is being a bit tricky about providing about it. Anybody done this recently? Thanks

Does your ex have parental responsibility and are there any court orders in place?

whatsnext2 · 22/06/2014 19:02

No, we are waiting for court approval for consent order which states she she lives with me.

When you've got that, you can use that. A court order that states that a child lives with you is like an old residence order and gives you permission to travel abroad for up to 28 days without the other parents permission.

Without that, you would need a letter from him giving permission or a court order that states you have permission for the trip.

Well, no phone number to call them on, so I emailed and they replied just referring me back to the website - aargh. This is what the website says:
"It is recommended that non-Brazilian minors travelling to Brazil, unaccompanied or accompanied by a third party or legal guardian, to carry a travel authorization signed by both parents and certified by a Notary Public." Can I assume therefore that a single parent does not need authorisation?

Sorry, I am clearly being dense here! Surely as a parent one is neither a third party or a legal guardian?

If your ex isn't on the birth certificate why would you have to get it? How would you get it if you didn't know who they were, no contact due to DV etc?
