Royal Mail have lost my friend's phone and she is being charged �300!

Please could you help or advise my lovely friend, wise MNs?

She ordered and received a nice new phone from T Mobile, but via a company called A Comms. After receiving the phone she found a better deal elsewhere, and arranged to return the phone to A Comms. There was no problem with cancelling the contract, no issue there. She posted the phone via Royal Mail "signed for" delivery on 02/04/14, and still has the receipt.

On 25th April 80 days had lapsed since posting the phone (this is important). On 28th April, she received an email from A Comms stating that they had never received the phone. Naturally, she chased the whereabouts of the phone with Royal Mail, only to be informed that they had lost it - they admit this. However, because 80 days elapsed between posting the phone and reporting it undelivered, Royal Mail say they are not liable.

On 12th June she recieved a further letter form AComms demanding payment of over 300 for the phone. We can see their point of view in the respect that they do not have their goods back, but they did not report the phone missing for over 80 days. Similarly, Royal Mail do state clearly on their website that losses will not be investigated after 80 days, but they admit they have lost the phone. Neither company will budge - she has spoken to and e-mailed them.

My poor friend cannot afford this bill, and she is worried about her credit rating. It seems deeply unfair that she is the only party who has done everything right yet she is being charged! Can anyone advise us who is liable or how to proceed? TIA.

Do you mean she sent it back on 4th February ? Was she instructed to use Signed for or should it have been Recorded delivery or another service ?

Yes, sorry it was 4th of Feb. I don't think she was given any specific instructions about the method of posting, but I'll check.

Hello all, I'm the one who's being charged, and I would be eternally grateful for any advice at all!

Also I wasn't advised either way, as to which method of postage to use whent sending the phone back. I just don't know what to do...

For an item of that value, it should really have been sent recorded delivery.
The post office staff usually ask if its an item worth more than a certain amount and suggest recorded delivery so I'm surprised it was only sent as signed for as that doesn't offer any tracking at all.

I would go through the Royal Mail complaints dept but I think they only insure signed for items for up to £50 or something.

Just checked, and yes, its a £50 cover limit, which means that, even if you had raised the issue of it being lost before the 80 days was up, that you would still be liable for £250 of the cost anyway.

The sender is responsible for any package they send until it reaches the recipient. If at any point the package is lost in transit, the sender must absorb the cost and then take it up with whoever was responsible for delivery.

If Royal Mail say there is an 80 day limit on claims, and on top of that they only cover £50 worth of goods, I don't think there is anything much you can do.

What about saying that you believe it must be theft and will be calling the police and getting and incident number. Is there any chance that the Royal Mail customer services will suddenly be more helpful?

I have no idea about this, but it hasn't just got 'lost' has it? Somebody's half inched it. Seems highly unfair that the sender should be so out of pocket.
