Online grocery shopping with Asda

We shop online with Asda for our groceries.

This week I ordered three items that were in an offer, three for £3. I placed order late Tuesday night for delivery on Wednesday morning. When I checked the invoice they hadn't applied the offer, so was charged £5.32 for the items.

When I called to query I was told that the offer was no longer valid on our delivery day so had been charged full price. I said I felt this was unfair as I had no way of knowing when offer was expiring. They don't show this on the website. The person said its in our terms and conditions. When dh checked t and c's it does say this but dated 7 May so recent change possibly.

So my question is, are they legally allowed to do this? Seems a bit dubious to me.

The only way to get a supermarket like this to take you seriously is to get trading standards involved. If there is no expiry date on the website, it could be construed as misrepresentation.

On a legal technicality, if you placed your order on Tuesday 6 May and they changed their T&Cs on Wednesday 7 May, the least they should be doing is sticking to the "old" T&Cs as the new ones were not in place at the time you placed your order.

Would be great if you pushed the case with Trading Standards - I realise we're talking about £2.32 in your case but it probably would help a lot of other people..

Thank you Lancashireman. Will contact trading standards. And you're right, it's only a couple of pounds but it just feels wrong to me.
