Can I submit an order for private school fees?

Hi all

I was issued a lump sum in 2006 and point 2 said:' Save as a foresaid both parties claims for ancillary relief are dismissed and neither party may: make any claim arising out of the a marriage under the Matrimonial cause Act 1973 s 23 or 24 as to income, capital or pension or school fees.'

Is this black and white?

Doesn't sound right to me. It's long been deemed contrary to public policy for the English courts to restrict claims made on behalf of children, so I'd be surprised if the court made an order I. Those terms. Have you quoted the exact wording, or have you paraphrased it? Do you need to make an application for school fees?

Yes I quoted from my order. I dint want make an app if I not allowed ??

I think it depends. If negotiations involved you getting a capital sum intended to meet future school fees I could see how the court might award you nothing unless circumstances have changed significantly. As babybarrister says , seek some specialist advice.

No it clearly says lump sum for providing accommodation for dependant.
