Deferring an interest in property

I am considering going to court to get an order that defers my ex's interest in our property to retain my home for myself and my children. He currently will not leave and I am desperate. Does anyone have any advice about how the court process works or any experience of this. I am terrified of the costs involved and the timescale. Do i have to attend court and give evidence? Will we both be interviewed? Is their any way I could lose? I am extremely scared of going down this route but have no other option.

Who owns the house ? How much is mortgage versus equity?
Can you take over the mortgage?
Where would ex go to live ?
How old are dc ?
Are you married or not ?

You need to have all the answers then discuss with solicitor
If you go to court to force it yes you need to attend and provide all evidence financial etc

You say "my" children. Is ex their father? And are you married?

The house is in joint names and their is plenty of equity in the house. I can afford to stay in the house and the mortgage company have agreed. My children are 5 and 2. We are not married but my ex is their father. I don't know where my ex would live but he earns three times as much as me and currently stays elsewhere half of the week. I think with a new gf.

Just concerned what he could do to prevent this happening.
