Urgent advice re 2nd hearing access case

Can anyone please help?
I am due in court tomorrow for the follow up hearing.
My ds' dad is petitioning for increased access.
My solicitor called me at 5pm to say it's been moved to the morning, they were not informed but found out by chance when calling to confirm the court number. I am worried that if ds' dad does not know and so isn't there, that it will be called off. Does anyone know if it might go ahead or will be cancelled?
Thank you

Can you contact him yourself?

NotSoNewNow · 28/04/2014 20:15

I could, I'd just prefer not to if it can go ahead without him being there.

Does he have a solicitor? If so they would most likely know.

Why don't you want him having increase contact? Normally they will adjourn the case for another day if they can't get hold of him especially if they find out he was never told

Thank you for responding.

He is self representing. I have concerns about my sons wellbeing whilst in his care. The cafcass report has made recommendations steps he needs to take before the length of access is increased.
I had to submit a statement which he responded to and then responded to that, so the judge will have had those 3 statements and the cafcass report.
Do you think that will make a difference as to whether it will go ahead even if he isn't there?

Normally if you have a solicitor they call you if you're not there, the fact he's self repping the court might try and phone him and ask why he isn't there.

From what I've heard they normally adjourn it and see if he turns up next time, and if he misses again close his application. They will take into account CAFCASS and the report done so if he hasn't done them then it's likely they will order him to do so and then schedule a review to see if he's done them

How's it going OP?

NotSoNewNow · 29/04/2014 21:06

My barrister was "happy" with how it went today. Ds' dad was unwilling to agree to any of the recommendations from cafcass. I was commended for my attemps to work with that report. Unfortunately nothing was resolved as he refused to engage in any negotiations. We are now moving to a full days hearing in 5 weeks...The best thing would be for him to behave in the manner he did today, which perfectly demonstrated the concerns I've raised. That way any increased access will have to be at a very slow pace with his agreement to attend an anger management course (he's currently refusing to as well as stating that he sees no reason for us to communicate at all ??.
I walked for over 3 miles as there was a tube strike today and did all this on 3 hours sleep thanks to my darling boy, so I am going to reward myself with a rather large glass of red wine, a shower and an early night!
