Passport Query

I changed my DS's surname in April 2013 by deedpoll (I am the only one listed on the birth certificate.)

I need to update his passport when I renew mine as we're going away in a couple of months. At the end of last year Ds's father was awarded PR and a couple of months later I was given a no contact order.

because I changed his name BEFORE the PR was given and I only have my name on his BC is it okay to send his deedpoll and his BC and a letter. Will they change it without any hassle or do they do some type of checks to ensure about the court order?

Fathers details are not on his passport application. I'm not going to send the court order stating no contact due to the fact the name change was before he had PR so at the time I only had to sign it.

Many Thanks

Why not send the PR order? It's proof that only you had PR at the time of the change of name. Presumably the PR order states the child's new name, which would help you. If the order mentions only the old name, the suspicion will be that the change of name deed was signed after the PR order.

I don't have it, I never knew it was granted until recently.

They also used my maiden name whilst at court so it will state the wrong name

I don't mean your name. I mean your child's name. The order won't show your name.
Are you saying that when you were served with the PR application you forgot to mention to the court that you'd already changed your child's name?

DuckyMoDuckyMoMo · 26/04/2014 23:07

Yes the order for everything is in the old name.

Then I think you're going to have trouble getting people to believe that the change of name deed really did predate the order.

But If I don't send the court order (having not mentioned it in the letter) How will they know?

You will have to state all those with PR, if my memory serves me well. They will want to see the order as proof that it post dates your deed.

Just found this on the Gov.Uk site

There are occasions when an unmarried mother will have changed a child’s name by deed poll and the father has subsequently obtained a parental responsibility order. In these circumstances, legal advice has been that at the time the change of name deed was executed, the mother was the only one with parental responsibility and therefore we should accept the change of name as valid

So they have to accept it
