Parking Charge

Hi.

I am really annoyed. I meet with an Autism Support Group each month and this time we chose our local Marks and Spencer's cafe. There have been some issues with a couple of our children and so the discussions went on for longer than normal.

I was the first to arrive and last to go as I also wanted to have a look around the shop and the others that the carpark serves.

I then received a Parking Charge Notice stating that I had overstayed by 26 minutes and to pay £100 reduced to £60 if I paid within 14 days.

I sent them a letter stating that I was using the car park to visit the shops it had served and also who I was meeting. They replied with the first letter. I sent them proof in the form of the receipt that I had luckily kept from the cafe. I did in fact purchase more but I didn't keep that one.

They have now sent me the second letter.

I really feel aggrieved to pay when I was using the facilities the car park serves. I have had a look at the money supermarket forums but I cant make head nor tail out of them

Should I pay up or not?

I think it depends who the letter is from. If you were parked on private land then I don't think it's enforceable.

Who is the letter from?

I would contact M&S customer services direct. I had the same issue with Aldi and when I contacted them they said as long as I could show that I'd either shopped there on the day, or was a regular shopper but didn't have the receipt for the day in question, that they would cancel the charge.

Unfortunately the Tory government changed the law a year or two ago so that these charges can now be legally enforced.

I followed this advice, and got my son's cancelled before court or POPLA appeal.
