Gaurantor needs urgent advice please!

My DH signed gaurantor for a (now ex!!!) friend. He fully understood that he was liable for rent arrears.

Now 'friend' has left the property with arrears of around £1000.

Friend says he repeatedly asked landlord to do repairs on property which were not done hence he left.

Agency are asking DH for the £1000 although he is currently discussing whether this should be paid given the lack of repairs done. Agent also says property was left in a state so will need cleaning which will need to be paid for though no figure given yet.

Now if ultimately the rent/cleaning costs have to be paid then although we would be unhappy we accept this is a consequence of being a gaurantor and will pay.

However, something else has come up which is really worrying me Sad

Agent is saying the tenant removed a boiler and gas meter from the property and hence police have been informed and are looking into it.

Now, I understand that the cost of replacing said items if they've been removed would be DHs responsibility.

However, surely he can't be held responsible for the act of removing them? He didn't live there and only visited once. My thinking is the act of removal would be blamed on the tenant?

Can anyone advise? I'm so worried and upset. We are honest, law abiding people and knew nothing of the boiler/meter until the agent mentioned it.

DH is contacting CAB on Mon but I'm going out of my mind Sad x

the lack of repairs is irrelevant, not paying the rent is not the way to deal with that. Given the 'friend' is a thief I can't be bothered to type out what he should have done. I wouldn't believe a word he says anyway.

your husband is liable for the rent arrears, no more - that is what he guaranteed. The damage will come out of any deposit, and hopefully the landlord has malicious damage insurance to cover the theft.

you can try small claims against the 'friend' - it would be a public service to give him a record.

I agree he should have paid the rent so looks like we'll be paying that.

It was mainly the theft I was worried about so thank you for giving the information.

As for the ex friend - I could cheerfully strangle him!!

I am of course not inciting violence...but I wouldn't blame you...

do check the terms of the guarantor agreement for final piece of mind, but I am pretty sure that is all that you would have agreed to.

BTW deposit is usually six weeks' rent. Replacing the boiler will be £1200 or more, a trashed property may cost the same or more again to put right.

and it is criminal offence to tamper with gas meters. He could have blown himself to perdition. The landlord will probably wish that he had.
