Day 79 of Arbitration and Landlord has upped his claim...

We are disputing the deposit deductions with our Landlord through the agent. I have heard nothing from the agent since 21st November (we have chased) and I have asked on numerous occasions to have a quotation and photo as evidence of the deductions he is proposing.

In frustration, I finally speak to the manager today who seems to get the ball rolling and she is shocked that we have not yet had the remaining deposit returned to us. She gets on the phone to the Landlord to chase the quotes/photos.

They have come back to us TODAY (DAY 79 of 90) to say the Landlord has changed his decorating costs from £200 to £1200.

WTF????????

I am speechless. How can an agent, who should have returned the undisputed part of the deposit before Christmas, now have the authority to up his claim? Can we sue the agent for incompentency/negligence of our deposit?

Is the Arbitration service going to work in our favour on this?

Not really sure how to handle - please help.

no chance! Which deposit scheme is this? The landlord has to prove the deductions and I bet he can't do that.

sounds like you've had agency staff of the type that I've come across all too often - answer phone, say yes, put down phone and continue filing nails/combing hair.

keep screaming at the manager, tell her when you expect action and also start threatening suing them.

I am currently filling my dispute with My Deposit…but their system has now crashed!

What action can we/should we take against the incompetence of the agency - because of their slack approach to returning our undisputed portion of the deposit, the Landlord has been able to up the dispute by £1000. Is there anything I can do?
