I have posted the information about the problem we have with our car here

I have now paid to have a diagnostic test run on the car, which shows up a fault with the solenoid valve. This will need to be replaced. The dealer has told me that they will not pay for the local garage to do it at a cost of £470, as they can do it for half the price. I do not think it would be safe to drive the car back to the dealer for repair, the car gave another big jolt, sounded stuck in gear and came up with the error message as I drove it home from the garage.

After much discussion with DH, we would now like to return the car for a full refund. After reading about the problem we have, replacing the valve doesn't mean it won't happen again, in fact it appears that it will probably happen again. We have had the car for just over a week now and had it less than a week when the problem started. Before I inform the dealer that I wish to return for a refund, I want to make sure that I am within my rights to do this, considering the car has a fault? I also want to check, if I inform the dealer of our intention to refuse the vehicle, do I just ask for them to pick it up? Some articles say you must not drive the car after refusing it. I just want to check I'm doing everything right and if anyone can advise me that I'm on the right track, I would be very very grateful.

It sounds like car is going into a failsafe mode which means it is indeed stuck in gear. If that is what is happening it would not be unsafe to drive the car back to the dealer but check with the garage that did the diagnostic test. They can confirm whether or not it is safe to drive and also whether you driving the car could cause further damage.

You are entitled to reject the car and have a full refund provided you do so quickly. Once you have rejected the car you must stop using it as it no longer belongs to you. It belongs to the dealer. As it is their property it would be ok to drive it back to the dealer at their request.
