My son jumped on by another child at school and still in pain

I'm not really sure what I'm asking to be honest but I'm feeling so angry with this other child as my son is still in a lot of pain.

This other boy deliberately jumped on my son's back while he was bent down putting a book on a shelf. He tried to deny it by saying it was an accident but another child in the classroom at the time saw it and told the teacher what had happened. The school had his parents in and he was given a detention.

But my son is still suffering in pain and has had to take quite a bit of time off school as when his back is hurting he can hardly walk and is in a great deal of pain. We've been to the doctors 3 times. Hospital twice. Once for an x-ray which was OK. And again when he was referred to the child assessment ward. They said that he was having spasms in his back and they would hopefully go as his back got better.

He's still having them so I bought a infra-red heat lamp hoping that heat would help. It didn't. We're now taking him to a chiropractor who said that his ligaments at one side have been stretched and at the other side squashed because of how the other child jumped on his back. Initial assessment was £59 and then we're paying £30 every time he goes. We can afford this but shouldn't the culprit be paying?

I just feel that my son is suffering while this other child has pretty much got away with it.

I'm considering reporting him to the police for assault as he was over 10 (Y7) and claiming from the criminal injuries board for compensation for DS and also for the costs of the chiropractor and any other treatment he may need. Or suing him in a civil court.

The longer DS is in pain the more angry I'm getting.

But the hospital found nothing wrong?

No hospital did find something wrong but just said it would have to get better by itself. That is often their answer with back problems. If your DS needs treatment to deal with the pain I would send the bill to the other boy's parents

shellbot · 20/11/2013 17:36

He's 11 and a half.

My fault for not reading OP thoroughly before.

I would think about massage if it were my kid, I would assume the muscles were pulled asunder by the blow and poor ligament support, too.

I also think it's really mean to sue a child & pursue criminal charges or civil damage over this.
You do whatever makes you happy, I just hope that someone is as unforgiving of your son when he does something equally stupid.

You sound ridiculous. Trying to sue an 11 year old ?! Madness!
Just take that it was an accident and move on!
