Child's clothing caught on faulty escalator

Hi

Just need some advice re my legal position, please. Visiting a big chain store yesterday, dd's trousers got caught (and badly torn) on a screw sticking out of the escalator. Store manager offered me £20 credit (trousers were more expensive, and from another store, so I refused) and did not close the escalator.

I am more worried about potential harm to other children than compensation - how should I approach this, please? Thanks.

You need to revisit the store and see if it's been fixed.

If I has, then no further action.

If not, you need to send an email explaining the risk to the store manager and any senior managers or H&S branches of the organisation, stating the risk and asking what their target is for fixing items which pose a hazard.

You could contact Head Office, but seeing as you declined the £20 credit I take it that you are after more compo?

Refer to HO, it normally comes under the remit of the Retail Director. £20 seems perfectly reasonable for the actual damage done but the H & S issue is more significant. Did they take your details ?

How old was your dd, they sometimes have signs saying children under a certain age need to be carried so might try and use that as a get out.

DD is 9. They didn't take our details.

I didn't think £20 was reasonable as the trousers cost more than that, and were brand new.

As I said, I am more concerned with making sure they fix it - before someone else has a worse accident - than compensation.

Then you need to email the RD and ask for assurance that appropriate checks and work have been undertaken. Enclose a photo of damaged trousers and copy of receipt .
