Hi can any one help. I have just had a visit from the police informing me that I am under arrest for perverting the course of justice. After seeing that I had a young child they said I can come down to the police station and be interviewed under caution. I asked if I needed a solicitor present and hey aid hat they could no advise me but if I do have one I need to tell them that it is an interview under caution regarding a statement I made some time ago and that I would not be booked in.
can anyone advise please.

Can you afford a solicitor? Honestly it would be best to have one if possible.

This is very confusing, your post doesn't make sense to me. Are you being arrested or not ? Or are you being interviewed under caution ? The two things are very different - the main reason being that you are free to leave at any time if it is an interview under caution.

As a detained person you are entitled to free legal representation. You will be read your rights as part of the booking in process. The police will get the duty custody legal rep for you (these are provided by defence firms on a rota basis). Do not be tempted to try and get a non criminal lawyer, even if they've done all your home legal stuff before. They wont be accredited to do police station work

And they won't comment whether you should have a legal rep, we are not allowed to. When DH gets up i will ask him about legal rights when being interviewed under caution rather than interview under arrest

From DH

You are entitled to free, independent legal advice when interviewed under caution whether under arrest, voluntary attendance at the police station or interviewed under caution in your own home (this has changed recently as you used to have to pay in your own home).

Legal representation is free up to the first court hearing.all you need to do is find a criminal defence firm as they will do police station work. They will deal with the legal aid forms

Hope this helps
