I have just returned from maternity leave (a leave of 4 months) to my job as deputy headteacher and prior to this, I had 8 months off due to forced sick leave (my headteacher refused to have me in the building as I was high risk re pregnancy). I was more than happy to come to work, but my headteacher refused! I have now returned to work but my school is facing becoming an academy due to various reasons. I am planning to go for another round of fertility treatment early next year and I have been warned that 'if' we were to become an academy, due to my very poor sickness record (most of it was 'enforced') I would lose my job. I don't want to not have another child due to this threat, but wondered where I stood legally if that were to happen?

Time taken off due to pregnancy-related illness should not count towards your sickness record. If they dismiss you for this reason you may be able to claim against them for sex discrimination.

I hope you received full pay during the forced sick leave. If you didn't that is also sex discrimination.

Your head teacher needs to check the law regarding pregnancy and discrimination before they get into trouble and cost the school a lot of money.
