separation - should I pay the mortgage when the deads are on Hs name?

Hi,

I am in much need of advise! I have just separated and my question is regarding the mortgage.

The Deeds are in his name, however I am the one who will be paying the mortgage as I will be living in the house with our 7yr old.

I don't really want to have official proceedings on this yet as this might have implications to the current process of my visa. He says he gives his word that by doing this he will not claim rights to the house down the line, but I want to be able to protect myslef with more than just his word.

I know the easier thisng would be to transfer the deed to my name but I can't because I am not a UK citizen...

Any advise on how to protect the asset I will be paying for with more than just "his word"?

Thanks!!

Were you married?

caramelwaffle · 02/09/2013 20:59

As Helen says it is important whether you were married or not.

Actually, in the title you say "H" so this will have a baring on what others who are more knowledge able can advise.

The Matrimonial Causes Act may apply in your situation.

  • Matrimonial Causes Act 1973 (rights to property as a married person)

  • www.landregistry.gov.uk (right to restrict sale of matrimonial property UK)

Hi. Just to say not a property specialist but pretty sure there's no requirement to ve a UK citizen in order to own a house. ..
