Anyone know about Spanish laws? Urgent help for my brother...

Hi all

Just wondering if any of you have any knowledge of the Spanish legal system?

My DBro has been working out in Ibiza for the past 2 weeks as a nightclub lighting technician. In his wisdom Tuesday night he decided to drink a skinful, drive a work van across town, knock over a Spanish moped rider and then drove away from the scene having to be chased and stopped by the local police. He's been in police custody since Tuesday.

My parents have today paid the bail money demanded by the police and have been advised this should get him released from cells latest tomorrow (as today is a public holiday there so money might not go through until tomorrow).

They have spoken to a Spanish lawyer who suggested that he might be sent back to the UK upon his release with the stipulation he returns at a later date to appear in court and be put through their justice system.

Does this sound correct? Is he likely to be asked to pay a hefty fine or would he receive a custodial sentence? Would this appear on his UK criminal record?

Agreed, he's been a twat and shouldn't have done it, but my parents are I are trying to establish the likely outcome of all this. Any guidance gratefully received.

Do you know how badly hurt the moped rider was? in a British court you would expect a custodial sentence for that little lot.

Why not ask the Spanish lawyer?

Thanks, yes I know he's been stupid. I'm getting snippets of info via dad who is in contact with Spain. Turns out the Spanish lawyer is just equivalent of free legal aid lawyers here and will just handle his bail application. Next steps I think is to get him on a plane home and get a uk lawyer to act for him. They are hoping they can plead to get his case heard here but I just wondered if that's even likely.

The moped rider was taken to hospital with minor injuries

Just not sure how this all works with arrests abroad and court hearings etc.

I think it unlikely for him to be tried here - all the witnesses. police etc are in Spain!

And yes, a criminal record abroad would impact over here.
