Driving instructor-what are my rights and where can I go from here?

I organised an intensive driving course with a particular company with a test as the end. Forty hours of tuition over a week.

I failed that test and took two further tests and a further 16 hours of tuition over the next month. I failed both of those tests.

After this I decided to change instructors and use my own car. My new instructor was horrified by how little I knew - from how mirrors should be set, to the MSM routine, meeting cars, moving off, manoevres etc I had never driven independently and had not been over huge portions of the town. I couldn't parallel park or bay park.

I had received very little feedback with the first instructor other than praise on how well I was driving. My requests for breaks, to focus on certain skills and more manoevre practice had been politely refused as unnecessary . We spent a lot of time just driving in a massive loop around the town, only approaching roundabouts from certain directions and never getting above 40mph. He just wanted to chat all the time, so i did very little learning, but with four tests in a month i was a wreck and not thinking straight. Even with 8 hours of extra tuition with a good instructor I still failed my fourth test two weeks later on something incredibly basic that we hadn't covered totally.

There were lots of other issues, but they are more for the DSA- aggression, discriminatory behaviour etc, but where I do i stand in a refund. CAB say I have a case as I paid for a service I did not receive from the company and the instructor. I have complained to the company and they said I received tuition, end of their responsibility. I have had some excellent advice from others and have written a complaint letter to send and asking for some money back, but if they refuse do I have a chance somewhere like small claims? Its a large sum of money to us and I don't want to write it off.

Four tests over two months, not a month, I did one a fortnight on his instigation.

At least 50% was not covered at all, 25% only touched on once or twice.

He said I was ready for the test, but every test threw up something I had not been taught properly or at all.

Test one-failed on changing lanes on a tricky part of the gyratory system/use of mirrors
Test two-failed on moving off/meeting other cars (examiner said I was dangerous).
Test three-failed on changes of speed/mirrors/positioning on tricky roundabout.
Test four- failed on observance at junction, indication.

All the manoevres were reverse around corner or turn in the road, thank goodness.

None of my errors were corrected, despite my pleas, we just kept going round and round the town on a loop. He never suggested postponing a test.

Report him to the Driving Standard Agency - they regulate instructors, check their standards & skills and, if necessary remove their 'badge'. Also find out if he was a fully qualified Approved Driving Instructor (green badge) or Provisional Driving Instructor (pink badge) as this will show what qualification level he's at.

Do you know have your licence or are you still receiving driving lessons but with another instructor/school?

Leverette - there's no driving instructor 'syllabus', as such. Each driving instructor will formulate a lesson plan based on the individual pupil and what they can do. They know what's needed to pass a test, but there's no actual 'plan' how it should be done or when a particular skill should be taught.

Iklboo- green instructor and the DSA were contacted last week. I know he has a lot if older pupils and one woman was going for her twenty eighth test with him (that was one of the final straws).

LoveSewingBee, I have my fifth test booked for the twentieth. I've had another twenty hours with new instructor and forty with DH who has let me drive everywhere including two trips to east London. I actually feel ready this time, whereas with the other tests I knew there were massive massive gaps in my knowledge and was shitting myself.

At the very least I know that I am no longer dangerous.

Oh and test dates

4th June
23rd June
9th July -last test with him
25 July-after eight hours with new instructor

Course started 27th may.

Total driving with him-56 hours.
