private landlord through estate agents had no bath/shower for two weeks

just wanting to know where I stand legally and what they have to do in order to fix the problem

two weeks and 1 day ago I reported to estate agents about down stairs ceiling collapsing and there is a big hole under my bath leading directly in to their property (down stairs have had a builder out who has said it needs structural work to correct the problem and my full bathroom and part of the living room will need to be pulled out in order to fix the damage) estate agents have passed blame on to the insurers and landlord saying they have done all they can its not there fault its not been fixed

I have had no use of my own shower bath for these two weeks as we are not sure if it will just collapse into downstairs house i have a 5 year old ds, how long can they leave us like this for my down stairs neighbour has now went on holiday for two weeks meaning nobody can access her property until she is back so its going to mean we have had no use of shower or bath for 4 weeks by the time she is back

insurance company did phone me today and are coming out to view the damage on Monday, my rent was also due yesterday but i haven't paid it due to not being able to use my own bathroom have i any rights to do this

I'm not really sure what you can do but ring CAB or your local council for advice. I would say though that when I had problems with my landlord (unusable bathroom due to pipes freezing when it got cold) they said that you shouldn't withhold rent as it puts you in the wrong and jeopardises your tenency.

Not a land law expert but fairly sure that under the Housing Act (1988, I think) the landlord has to keep sanitary installations functioning and if he doesn't, you're entitled to get someone in to do it yourself and Jen set off the cost against your rent.

Shelter or CAB should be able to clarify.
