Posting on behalf of a friend. Friend (F) is separated from husband and has two children. ExH and DC are british F is not. F has overstayed on visa and has been told she is an overstayer and has no longer got access to public funds like housing benefit. Can now not afford to pay for house and has stopped working. Genuine mistake F has made do not need any negative comments as F needs help. ExH is in a relationship with someone else. F wants to go home and reapply but is worried she wont be allowed back in the country yet if she stays has no way of supporting herself.. Ive suggested the wisedom of mumsnet to give me some suggestions...

From what you said, it appears that she is here on a FLR visa which has now expired and never got round to getting the ILR?

There is a way to apply to stay in this country, it's called ''access rights to a child resident in the United Kingdom'' but there are problems from your friend's point of view:-

She must be able to adequately maintain and accommodate herself and her children without recourse to public funds.

Another way to go is to make an accusation of domestic violence against her partner. Although I would strongly urge her not to do this if it did not happen.
