Inheritance and separation

My H inherited some money a month or two before I told him I want to separate. He now says this should be kept as his and not divided with everything else when we split our assets. His parents agree and say they will take the money back to give to him later if there's a problem as they believe it was intended for him, not for this.

Is that legal?

(I'm not sure I want the money if it's going to cause a rift with the in-laws; I have to get on with them for the sake of the dcs, but it would still be useful to know!)

The inheritance has to be declared and forms part of the pot to be split between you. That doesn't necessarily mean you will be entitled to any of it. If there is enough money to meet the needs of yourself and your children without eating into the inheritance he may get to keep all of it.

Agree with prh47. I have rarely come across an inheritance case where there was a split as such; only in cases where there was very little else to fight over.

Ok, so it sounds like it's dealt with differently from other assets but can't be squirrelled away. Thanks for the answers.
