Starting divorce proceedings with no money

After some years of emotional and verbal abuse, I am at the end of my tether. I want my DH gone with the minimum of fuss. I am currently unemployed but we both own the marital house outright and have no mortgage. DH has a private and state pension which keeps us afloat. I am 57 and have no income except child benefit for our youngest son and some working tax credit. Once the house is sold, I would have enough to pay fees etc. Is there a straight forward way to separate from your DH without racking up huge fees and angst?

You can divorce without a solicitor, I did, but that was a straight forward agreement between me and my ex, no hard feelings or arguments about who got what.

At the very least you need legal advice, most solicitors will do a 30 minute free consultation.

And you could use a 30-minute free consultation (shop around; then you get a few of them!) to see whether you're eligible for legal aid under the new system.

Ask Women's Aid to recommend a solicitor who is experienced in cases involving domestic abuse.

Information here about what you need to get access to legal aid for divorce matters.

Also, if you are eligible financially for legal aid, you can still get free legal advice in support of mediation, and mediation will also be free.
