SMP - Am I being discriminated?

Under my employment contract I am entitled to 6 weeks SMP (at 90%) of my average salary followed by 33 weeks at standard SMP. However, the paternity policy at my company is two weeks enhanced paternity pay at full pay (rather that lower of SSP or 90% of salary).

Is paying paternity pay at an enhanced level but maternity pay at statutory level not discriminating?

I very much doubt it. 2 weeks at full pay is still a heck of a lot less than 39 weeks at SMP. I think the system is discriminatory to men, but then I live in a country where both parents get 240 days each at 80% of pay.

No, it really isn't. The fact that the minimum statutory requirement for paternity leave is ridiculously short, whereas the minimum for maternity is just about adequate (though obv would be nice if it was more) means that it is perfectly reasonable for an employer with a sense of justice and fairness to offer more than the minimum to men.

If the law made mat and pat equal and they STILL offered more to men, that would be discriminatory certainly.
