Rules of intestacy

I just wanted to check my knowledge on this.

If dying intestate the first 250k of an estate will go to spouse, remainder to children split equally given to them at 18.

If no spouse/partner it goes to the children equally.

If no spouse/partner or children to parents.

If none of them either next surviving relative.

Am I also right in thinking that anyone related to you by marriage does not inherit?

You have the right idea, but:

If there's a spouse, they get the first £250k plus a life interest in half of the remainder. The children get the other half of the remainder in equal shares.

You are right that if you aren't married or in a civil partnership, your partner does not inherit anything without a will. If, however, you own a property as joint tenants rather than tenants in common, then your share passes to the co-owner even if you're not married.

I'm a qualified will writer and have an advert over on Classifieds/Small Business/"5*Will Writing Service Recommended by Mumsnetters" if you're interested in making a will.

You did my last will actually. My husband and I do need to do a mirror will now though, so I will be in contact in due course.

This post was more to do with checking my knowledge wasn't out of date for work!
