i recently bought a large item on interest free credit. i paid a deposit and a credit agreement was sent which i signed and returned.

the item was delivered

today they rang to say that i still owed money - on inspecting the paperwork it seems the creditor omitted to include the VAT.

i did not fill in the paperwork - the company i bought the item from did. Now they have realised their mistake that are asking for me to pay up - i have no objection but i dont have the cash available.

any ideas what i should or can do about this?

i asked it the VAT could be added to the original credit agreement given that none of this is my mistake.
heard nothing back.

If the ticket price was the lower figure and didn't state vat was to be added they can't simply add it now.

really? is that true?

they were quite arsey with me on the phone yesterday when i said i wanted to check the paperwork.

it was an expensive item - over a thousand pounds so they are saying i owe them another £192.

ive not heard anything back from them with regards whether its being added to the credit agreement or not.
im confused.

From a contract point of view, vicar, the paperwork constitutes the offer, your full payment the acceptance. The bargain is concluded. The firm is liable for the VAT, not you personally. If you have paid the amount specified they can't pursue you for extra after the fact. Or everyone would do it! I wouldn't pay, but then again I doubt anyone would extend me a line of credit...

well i cant very well argue - whats happened is the price was on the invoice - the credit agreement came out and i signed and returned it - the figure was correct but was pre VAT....

on the invoice the VAT is added but separately....so on the face of it the figures looked the same.

i cant argue that i owe it - but they missed it off and it was misleading. im paying it now anyway - they threw the fact im a cop at me! i said i wasnt trying to dodge the bloody VAT but i couldnt just pay up another £200 just like taht because they cocked up!

so its been added to the credit agreement -its 0% interest anyway.
