employment contract

my partner has been issued a new contract that has lots of issues that he and most of his co workers disagree with.

some have apparently put it straight in the bin which he intended to do but he has been told they have 5 days to sign if they dont sign then it will be taken for granted they agree with everything and filed as if they had signed.

does anyone know if this is legal. the above bit that is

things that they are disagreeing with include having to work weekends and bank holidays when requested for day off in lieu.

having to work anywhere within a 60 mile radius of where they live. being able to claim fuel but having to insure car at their own cost for business use.

lots of other things seem stacked for employer (i know thats prob the point but this does read very unfair).

Having recently issued new contracts for my staff I have received advice about this.
Firstly he should raise he concerns with his employer. He can choose to sign the contract excluding certain clauses.
If he does not raise concerns and continues to accept his pay over time this weakens his case against these clauses.
I have a member of staff who choose to strike through one clause ( which would never apply to her) and then accept the rest of the contract.

thank you they thought that by not signing the contract it was raising concerns about what was in it, until they were told it didnt matter if they signed or not he was told to sign and then raise concerns but i thought they would just say well its to late you signed it

could he cross out the bits he disputes then sign it would that work do you think.

my oh had thought one clause didn't apply to him but i said that as it had his personal details on it then everything in it apply's to him.

He needs to raise his concerns with his employer (this is a requirement on his side for changes in contract) and advise them that he is choosing not to accept this clause. I would suspect they will then take advice from their HR advisors.
