Dear legal eagles I have recently discovered that I have been paying a long forgotten mortgage endowment policy which matures in 5 years current value around 12000 pounds.
It was taken out in 1992 when married to now exh and is in both our names, we separated legally in 1998 but did not divorce until 2007.
I always thought this policy was named in the divorce and awarded to ex but there is no mention of it, only another life insurance policy which is why I was confused I think?
Divorced in Scotland if that changes anything.
What should I do?
Only I have ever paid the premium.

Don't know about Scottish law, but you are both the owner of the policy. By default, the proceeds of maturity will be divided between you both equally.

Just be warned, I was iold that the cheque would be sent to the first named person on the policy.

Ok thank you both, I spoke to my solicitor today and she feels that if it was not decided in the divorce I might be able to keep most of it as only I have ever paid it.
I need to have the minute of the divorce checked first.
Fingers crossed :)

Mine was split 50/50 between us.

If it's in both your names then the split will be 50/50 . how can you have forgotten asbout it if you were paying the premiums?

Hi Helen B I thought it was another life insurance policy I had taken out.
It was only when I got a statement on the same day as a bank statement and noticed the figure that the penny dropped. Bad financial housekeeping on my part.
