starting new job, worried about contract

Starting work as care worker. Basically normal number of hours to work each week is 28.25 hours but it is anticipated that i may be required to work more than 48 hours. Am very concerned about this and am wondering if they can actually force me to work more than my agreed 28.25 hours. Would appreciate any help/answers

This is probably something to do with the working time directive. The purpose of the directive is that no one should work more than 48 hours a week - however uk has an opt out so some employers as a matter of course ask employees to sign if they are prepared to waive their rights under the directive. You don't have to agree to it - if it is a tick the box option then just don't tick.

Also even if you agree to it in your contract you can change your mind at any time by giving your employer 7 days notice. They cannot dismiss you for not opting out.

Check yougov for your rights.

What's the wording in the contract that is concerning you?

littlemissangrypants · 09/08/2012 09:44

Yes quite a bit. I have spoken to them and they have assured me that they know what hours i'm available. I know i need to make a decision today but am very worried i might make the wrong one. I have two children (one of whom has special needs) so i can't work more than part time hours

It's very difficult to advise you without the wording as I said. Can you tell us what it is?
