Contemplating leaving my other half but have no idea where to start. We have a morgage free house that is on the market but not selling. He also came into some money- alot- £126 thousand pounds!! He has always viewed this as his money. He used some of it to pay off the morgage but has always said that I need to pay my half to him. I have no idea what my rights may be if we split can anyone help?

You might have to, but you should take some legal advice.

stellios · 10/07/2012 10:23

Just to add we have four children I have no idea if this changes anything.

A body of family lawyers committed to a code of conduct that is sympathetic to resolving family disputes sympathetically.

if you not married it is about childrens act for support for children and trusts of lands act

as to who is entitled to what.

get all financial papers and valuations for house etc togetehr before you go to a solicitor so you have all the info to hand.

He must contribute towards the children if you split up usually until they are 19. If he refuses you can go to the Csa However they would only assess his income and the 126 grand would not count unless it is invested say in an account attracting interest Nb the Csa doesnot backdate so any money from it starts from the day you start your claim

CSA ascribe notional income to capital savings.

Putthatbookdown · 11/07/2012 15:41

Collaborate, what does that mean? Thanks x

prh47bridge · 11/07/2012 17:59

It means that if he has savings of £65,000 or more the CSA will assume he is getting an income from those savings and will include that income in their calculations.
