Hi, I am trying to find out if I can fence my front garden (I have 2 threads alreadyBlush www.mumsnet.com/Talk/legal_matters/1484897-Me-and-my-much-wanted-fence-again. Basically a RL solicitor has told me I am not bound by the original covenant as the builders no longer exist and it could only be enforced if we were in a building scheme, however this sounds like a building scheme to me; (I'm not sure the solicitor read my documents in much detail, any ideas? thanks)

For the benefit and protection of the remainder of the vendors said estate at xxxx aforesaid and to bind as so far as pracitcable the land hereby jointly and severally covenant with the vendor that the purchasers and those deriving title under them will at all times hereafter observe and perform the stipulations contained in the first schedule hereto but so the purchasers shall not be liable for any breach of covenant after they shall have parted with all interest in the land hereby conveyed-

As I've said before even if there is a covenant,, worse case scenario is that you have to remove it so if I were you & really wanted the fence I would go ahead & do it!!! Maybe talk to your neighbours fist though.
