I feel very grown up posting in this section as normally I only post drivel in chat Grin

Does anyone know how long a conviction for assault and battery (not custodial) stays on your crb certificate?

Tia

Have had lots of CRB checks as a nurse Grin not as a master criminal!

To the best of my limited knowledge, everything stays on it forever! Not parking fines but certainly criminal activity like assault.

See here www.direct.gov.uk/en/employment/startinganewjob/dg_195809

Sneeze is right, even unspent convictions will show up

Sirzy · 23/05/2012 21:16

It shows up, but that doesn't mean that you will turned down for whatever you are applying for just that they know and then will make the decision based on that IYSWIM.

The best thing though is to be up front with them.

Thanks for all the info.

I can't believe it stays on forever, that really sucks Sad Sad

Even accepting a caution will show up forever. You should be given an opportunity to disclose after accepting job offer but before CRB check.

Ladymuck · 23/05/2012 22:11

And your employer can only do a CRB check if they have a policy on fair treatment of ex-offenders.

BrazenHussy · 23/05/2012 22:18

Thats interesting Ladymuck

If it is an Enhanced CRB it is never spent If it is a Standard CRB then it will only be Unspent ones. This is so pathetic: people with the most minor things are being hassled when the whole idea is to safeguard vulnerable people. Anyway Professional Associations also have a a role too? DFEE and RCN can bar people. Employers can only act if either there is a pattern of reoffending or a Relevant offence has been committed: Relevant will be fairly obvious and they cannot employ you e.g sexual abuse of a person in this caseBut with a minor thing that happened years ago as a one off I doubt they will be interested

No, spent convictions appear on a Standard CRB check. The difference with an Enhanced check is that the police are consulted to see if there is any information they wish to disclose - investigations that have not resulted in any kind of criminal record, for example.

Just for clarity, CRB checks can only be used by employers entitled to ask exempted questions under the Rehabilitation of Offendors Act 1974. Most employers cannot ask for a CRB check.
