Anyone been to court with a PPI claim

Started a claim for PPI with one of those no win no fee solicitors and to cut a long story short its going to court next week. My OH and I are shitting ourselves am hoping they might settle before but its looking doubtful.

Has anyone been to court with this and did they win and how good are these no win no fee solicitors?

I don't understand why it's going to court. Is the lender saying that you weren't mis sold PPI? Did it go to the Financial Ombudsman?

No it didnt goto ombudsman, its our solicitor doing the negotiating. Basically the lender is saying we knew what we were doing.

Who are you going through OP, if you don't mind me asking? I have an old man that i help out occasionly who is looking to claim back his PPI from various places. I have lots of messages left on my answer phone from different companies but am always dubious of cold callers. Always think they are trying to rip you off too.

It was originally Donns but has been taken over by C Turner same solicitor though. If it wasnt for the fact I really need the money I wouldnt bother going through it. Never been to court in my life.

That sounds rather odd to be honest. The usual process is that you make a complaint to whoever sold you the PPI and then if they knock you back you escalate your complaint to the Ombudsman. As far as I know, if the Ombudsman rules in your favour it is binding and the lender has to cough up.

Court should only be a last resort and only if the Ombudsman ruled against you. But tbh if the Ombudsman rules against you I can't see a court coming to a different decision. I think you need to ask your claims company/solicitor for an explanation of all the steps they have taken and why they haven't gone to the Ombudsman.

I second the suggestion that you post on Moneysavingexpert PPI forum for advice, they are experts over there.

ilooklikegrotbags all the man you help out needs to do is to complain to the company who he believes mis-sold him the PPI. We have just claimed ours back from Nat West and the Halifax, all it took was one phone call to each of their PPI complaints line and we were given an offer 8 weeks later. If I were him I would avoid those "no win, no fee" places because it is very easy to do yourself.

Ilooklike avoid those companies, they will just take a chunk out of whatever payout he gets. It is very easy to claim without their 'help.' Go to Moneysavingexpert and there is a how to guide, loads and loads of advice and a copy of the form to download.

No disrespect to the OP - these companies traded on making the claims process sound far more complicated than it is and to be fair since so many lenders have now had to put huge chunks of cash aside to deal with all the claims they have made their claim processes much simpler than they were previously.

Am afraid can't help with solicitor query but ilooklikegrotbagstoday, your friend doesn't need to use a solicitor or claims management company. Can claim back missold PPI direct from bank / via ombudsman using straightforward form (templates on moneysavingexpert.com). That way, nothing gets creamed off - most sols/claims management companies will take %. We made a successful claim ourselves. Took about 12 weeks from start to finish. OP, do you have to go through with ct case? Don't know much about these things but wondered if this was a route you could try instead?

Midge I wish we didnt have to go. We are just following the solicitors advice. Our case is complicated, think it has something to do with it being a broker. The broker says we knew what we were doing but having someone that understands these things and explaining it we clearly didnt.

Dont know if the solicitor has gone to financial ombudsman.

So, on what basis is the lender saying you knew? We have had a successful PPI claim on the basis that DH first of all was not given the option of taking the mortgage without the PPI, and also on the basis that he had been employed for years at the time and therefore entitled to the sickness benefits etc.

It may be an idea to have a look at the PPI form on the Financial Ombudsman web site to give you an idea of the criteria.

While it's true that just because someone has purchased PPI, doesn't necessarily mean that they were mis sold it, the vast majority of people did not have a choice...

Yes, we did AuntieMaggie. We knew because when we went to claim on it, years and years ago we couldn't because DH had pre-existing medical conditions!

So far we have had offers of refunds on a loan and our mortgage. They are still looking at the credit card.
