Form CPR part 7 issued after insurance settled following a car accident -how do we deal with it?

DH had a car accident last year where basically he lost concentration and hit the central reservation on the motorway. His car was a write off and there was damage to the central reservation, but no damage to other people or vehicles. The police attended the incident but didn't charge him with anything. The car insurers fully accepted the claim and paid in full.

We had a letter from the company responsible for the maintenance of the road asking if DH or the insurance co would be paying for repairs to the central reservation and DH gave them the insurance details.

Now today DH has received form CPR part 7 claiming for the cost of the road repairs via a solicitor. As far as we were aware, all costs had been met by the insurance company and the matter was closed.

The form is asking if DH accepts liability for the costs, or what his defence is. I guess he needs to call the insurance company as soon as he gets home but are we going to be landed with this bill?

I think the insurance should cover it - but they've had over a year to do so and haven't, and we've now got to respond to the court within 14 days.

DH is really upset, which makes it really difficult Sad

madness, this should be handled by your DH's insurers - if you haven't already, I would strongly recommend that your DH contacts them and asks them to take over the handling of the claim urgently (they have 14 days from the date the claim was issued to acknowledge it).

You shouldn't be landed with a bill for this (third party liability is covered under all motor insurance), other than the insurance excess which I'm guessing your DH has paid already.
