Can someone tell me about "betterment" re damaged goods please?

OK, this isn't the most important question in the world but as a buyer and seller on the dreaded ebay I'm as much intrigued about where both parties stand as in need of advice.

A quick example - I bought a dinner service from a private seller on ebay. It's arrived with some items broken, damaged in transit. I've just emailed the seller to explain, offer photos and request a refund but am I within my rights to expect a full one? Or am I only entitled to a refund which is proportionate (eg, if I paid £30 for six items and two of them were broken in transit would the seller be within their rights to offer me a £10 refund)?

Or, would I the appropriate response be for the seller to pay the cost of replacing the particular items which had arrived in pieces?

I suspect if they are matching items/ a set, then I would expect a full refund. If you returned to a shop you would expect a new set . If you bought six individual items and they were shipped together than that would be different. IM(non legal)O.

Ebay wise -they are not as described at least, surely, unless you bid for pieces of mosaic Grin ? Fergoose on the Ebay topic is usually v good with this sort of thing Ebay topic
