Massive issues with Citroen following purchase from main dealer. Can anyone please help re the legal side of things?

I purchased a Citroen C4 Grand Picasso 7 weeks ago from a main citroen dealer.

The car is 4.5 years old and came with 3 months warranty. Only it doesn't come with warranty because Citroen tell lies. It only has a 3 month mechanical guarantee that covers the first hundred pounds.

Last week the car developed a fault and the main fuse box needs replacing.

This is how I found out about the useless warranty.

Now, following advice from the lovely people trading standards and citizens advice, I have put into writing about the sale of goods act and consumer rights.

Citroens answer? They will repair the fault if I sign a disclaimer to say that they are not liable for any other faults that occur Shock

They are also trying to bully me into purchasing an extended warranty that is ££££.

Not sure where to go from here tbh.

I am massively stressed out by all this and am hoping that someone can please help and advise me where to go from here.

Thanks Smile

Your contract is with the dealer, not Citroen. I presume when you say Citroen want you to sign a disclaimer you mean the dealer.

Stand your ground. There is no reason to sign a disclaimer or purchase an extended warranty.

I would tell the dealer that you will not sign any disclaimer nor will you purchase an extended warranty and if they continue to refuse to repair your car you will get it repaired elsewhere and take legal action to recover the cost of repairs. Provided the repairs cost less than £5000 you can use the small claims court.

Alternatively if you bought the car using your credit card or with a loan you could take it up with the credit provider. They are also liable for any problems.

Thank you very much.

Yes I understand the contract is with the dealership not actually citroen although I find this slightly confusing as they are a named dealership in citroen iyswim?

The cost of the repair/part is not massive and I can afford it but it is more the principle of the matter. I don't feel they should be getting away with this.

However, I am wary of running up extensive legal fees.

You will not run up extensive legal fees. You do not need a solicitor to make a claim through the small claims court. Your only legal cost will be the court fee which you will be able to claim back from the dealer if you win. Even if you lose you will not have to pay the dealer's legal costs.

Oh I didn't know that prh47.

I thought I would have to get solicitors involved etc.

Honestly, I am so so pissed off that they think it's okay to treat someone like this. They shouldn't be allowed to get away with it.
