Question about enforcing a County Court Judgement

I have a county court judgement against a local company (company A) and was going to use the bailiffs to enforce this, but I have noticed that there is another company (company B) registered and operating from the same premises. They are also in the same line of work. My question is, obviously my claim is against Company A, if I send the bailiffs in would they just say all their assets are Company Bs??

I'd check with companies house to see who is running both companies. Company B will have to prove that they own the goods, so show receipts in their name etc.

Thanks LadySybil, I knew I forgot to put something in! I have checked this and they are run by 2 different people.

It will still be the same. The bailiffs will take the goods unless company B have documentation to prove that the goods belong to them. The bailiffs will not take their word for it.

My dd had ccj against someone not a business when bailiffs went she said everything in the house was her mums who she lived with They took her word for it dd never got any of the money owed, gave up trying in the end.

LadySybilDeChocolate · 17/03/2012 23:38

They are not supposed to do that, love. Shock

lovebeinganana · 17/03/2012 23:43

No I didn't think so, but everytime dd went back to court offices to ask what next step was it always involved paying, the costs are always added to the amount owing to her but if she can't get the money that doesn't matter. DD has given up because she doesn't see the point in continuing she never gets anywhere.

I feel Angry on her behalf! People like this make a mockery of our courts.

It's not very great, the court have said we are owed money, but there is no sure way of getting it back - it's a gamble!

If the judgment amount is £600 or above consider transferring the enforcement of the judgement from the County Court to the High Court so a High Court Enforcement Officer can call - they have additional powers. Read about it at www.highcourtoffice.co.uk, you can do it on-line and they cover England and Wales,

good luck
