I am currently filling out an N5b accelerated possession form and am having difficulties with a couple of questions.
My situation is that i am 7 months pregnant and originally moved back to my mothers house to save money. Following a year of painful saving and budgeting, we are now ready to move back to our property.
We have a shorthold tenancy agreement which is being managed via a letting agent and they have served a section 21 (4) (a) notice on the 20th January 2012. The Tenancy agreement ends on the 20th March 2012. The tenancy agreement started on 21st March 2011 and had a 6 month break clause.
The tenant had informed us that they would be leaving the property on the expiry date of the notice and therefore we planned for a considerable amount of building work to be scheduled for the following day. I have just been informed by the lettings agent that the tenant has decided that they will not be leaving the property and i believe they may be attempting to claim a council property due to being a dss tenant.
Now to the point:
- Question 3 c) - Do i enter the date that the tenancy agreement began? It states (before the tenancy began) and am slightly confused about this date. I have an agreement date on the contract which was the 15th March 2011, this is not the tenancy start date. Is this the date that i enter?
- Question 3 d) which form do i attach marked 'B'? I only have a tenancy agreement which i thought is marked as 'A'
- Question 5 - It asks for a date that the notice expired. The notice expires on the 20th March 2012. Do i provide this date or the 21st March 2012 (the day after it expires)?
If anyone can help me, i will be highly greatful as this is a very stressful time for me.
