Financial rights on separation

Ds and his partner of 11 years are splitting up. He is going to buy her share of the flat from her and try and make everything as amicable as possible.

Ds has his own business and she is in a high powered job but his concern is whether she has any rights to the business as some one has told him that after 7 years together she would be entitled to half the business even though she has not put any money into it. She has however helped him sometimes. Is she entitled to half the business.

Hope someone can help.

Short answer. If married, yes, she is possibly entitled to a share - unlikely to be anywhere near half though (depending on a whole load of other factors).

If not married, no, not entitled.

No they are not married - I had been hoping they would be as I would have liked that to happen as I am very fond of her but in some ways it should simplify things as they didn't marry.

My BIL was in the same position (but separating) and was told legally she had no right to any business assets, especially as she had not contributed to it in any way.

Just to reiterate what MOS is saying, the partner has no rights under family law. I presume that she isn't a partner or director; if not, then she won't get anything.
